1. The service
Arcalect provides municipal intelligence, including briefs, alerts, dashboards, and analysis, to institutional subscribers under a subscription agreement. These terms govern use of the service and this website; where a signed subscription agreement conflicts with these terms, the agreement controls.
2. Subscriptions & billing
Subscriptions are annual, billed in advance, and priced by tier. Seats are named and non-transferable between individuals except by administrative reassignment.
3. Acceptable use
The service may be used only for the subscriber's internal government-affairs, planning, and leadership purposes. Subscribers may not resell, republish, or provide the service to third parties; may not use the service to harass any individual; and may not represent Arcalect analysis as the product of the subscriber without attribution in external proceedings.
4. Intelligence, not advice
Arcalect provides information and analysis, not legal, lobbying, or compliance advice. Subscribers are responsible for their own decisions and for compliance with laws governing their conduct, including lobbying and election laws.
5. Confidentiality
Each party will protect the other's confidential information with at least the care it uses for its own. Client configurations and briefs are the subscriber's confidential information; the platform, its methods, and its analysis engine are Arcalect's.
6. Disclaimers & liability
The service is provided "as is." Arcalect does not warrant that every relevant proceeding will be captured or scored correctly, and aggregate liability under these terms is capped at the fees paid in the twelve months preceding the claim. Neither party is liable for indirect or consequential damages.
7. Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, with exclusive venue in the state and federal courts of Suffolk County, Massachusetts.
